The Food Safety and Standards Authority of India also commonly known as FSSAI is a self-governing body established by the Ministry of Health and Family Welfare of the Government of India. In India, the FSSAI is in charge of regulating and monitoring food quality, safety and standard. To ensure that the food products available in the Indian market are safe and of high quality, FSSAI has implemented a licensing system known as the FSSAI License.
FSSAI was founded in 2006 to bring together numerous food safety laws under one platform. FSSAI sets food standards and ensures that these standards are met by Food Business Operators. It also regulates food production, storage, distribution, sale, and import to ensure that it is safe and suitable for human consumption.
All Food Business Operators also known as FBOs in India must obtain an FSSAI License before starting the operations of the business. The FSSAI License is a 14-digit registration or license number that needs to be displayed prominently in the place of business. The manufacturer or Re-packer has to ensure that the FSSAI License number is printed on all food products or packages. The license is granted to food businesses after they comply with the food safety and hygiene regulations set by the FSSAI.
Types of FSSAI License:
- Basic FSSAI License/ Registration – The Basic FSSAI License commonly know as FSSAI Registration is appropriate for small food businesses with a yearly revenue of up to Rs. 12 Lakhs. The basic FSSAI License can be obtained for a validity period of 1 to 5 years. This license is suitable for home-based food businesses, petty food business operators, small restaurants, food carts, hawkers and market stalls.
- State FSSAI License – The State FSSAI License is suitable for food businesses with an annual turnover of between Rs. 12 Lakhs and Rs. 20 Crores. The FSSAI State License, fresh or renewal can be applied for a validity period of 1 year. This license is suitable for small to medium-sized restaurants, food processing units, food caterers, and medium-sized producers in the food industry.
- Central FSSAI License - The Central FSSAI License is suitable for food businesses with an annual turnover exceeding Rs. 20 Crores. The Central FSSAI License, fresh or renewal can be obtained for a validity period 1 year. This license is suitable for major restaurants, food processing plants, food caterers, and large manufacturers.
Documents required for FSSAI License:
- Directors / Partners / Proprietor – List of Directors / Partners / Proprietor with full address and contact details
- Identity proof - Any government-issued identification document, such as a PAN card, Aadhar card, voter ID card, or driving license, can be provided.
- Address proof - Any government-issued address proof, such as an electricity bill, phone bill, or property tax bill, is acceptable.
- Company Documents - If the food business is a partnership or a company, the partnership deed or memorandum of association and articles of association need to be submitted along with the Certificate of Incorporation and Company Pan Card.
- Form IX - Nomination of Authorized Person as per clause 2.5 of FSS Rules, 2008
- Analysis Report – Analysis report of water if it is being used as an ingredient in Food
- Import – Export Code – Import Export Code or IEC if Food Business Operator is an Importer or Exporter of Food Products
- Food safety management plan - Together with the application, a document explaining the food safety management plan must be presented.
- Proof of possession of premises - Proof of ownership or a lease agreement for the premises where the food business is located is required.
- Plan – Blueprint / Plan Layout of the processing unit and space showing dimensions in metres and sq. mtrs
- NOC from Municipality - A certificate of no objection from the local municipality or panchayat.
- List of food products - The list of food products that the business is going to manufacture or sell needs to be submitted.
Fees for FSSAI License:
The fees for the FSSAI License vary depending on the kind of license, the period of the license, and the kind of food business the individual operates. The fees are as follows:
- Basic FSSAI License - The fee for the basic FSSAI License is Rs. 100 per year.
- State FSSAI License - The fees for the state FSSAI License are Rs. 2,000 to Rs. 5,000 per year depending on the business.
- Central FSSAI License - The fee for the central FSSAI License is Rs. 7,500 per year.
Renewal of FSSAI License:
The FSSAI License must be renewed before 30 days of its expiry. A late fee of Rs. 100 per day will be calculated till the license is renewed. The license can be renewed even after it has expired, but only when the penalty has been paid. The renewal procedure is similar to the application procedure. The required documentation, as well as renewal fees, must be submitted by the food establishment. The FSSAI License fresh and renewal payments are the same as the initial fees. FSSAI License can be renewed for up to a maximum of 1 year as per the new notification.
